How Does Rent Control
Work for Tenants in Alameda?

Navigating the rental landscape in Alameda can be daunting, but the city’s Rent Control, Limitations on Evictions, and Relocation for Certain Displaced Tenants Ordinance, often referred to as the Alameda City Rent Control Ordinance, or Alameda RCO, offers significant protections for tenants. This page provides an overview of the key provisions, how they work to protect tenants, and where you can learn more. 

The ordinance, codified under Alameda, Cal. Mun. Code § 6-58, was enacted to ensure fair rental practices and provide stability for tenants. It regulates rent increases, outlines just-cause eviction protections, provides tenants with relocation assistance in certain cases, and offers anti-retaliation protections. Its scope creates a more equitable rental market while safeguarding tenant rights. 

  1. Regulated Rent Increases

According to the ordinance, landlords can only increase rent by a set percentage referred to as the Annual General Adjustment (AGA). For covered units built before February 1, 1995, rent increases are capped, ensuring tenants are protected from sudden, unaffordable hikes. Any rent adjustment beyond the maximum allowable requires specific approval. This framework provides tenants with greater predictability and financial security.  

Not all properties are covered under the rent-ceiling provisions. For example: 

Exempt units include government-owned or subsized low-income housing. Landlord co-occupied property, and dormitories.

  1. Just-Cause Eviction Protections

The ordinance prevents landlords from evicting tenants without a valid legal reason, as outlined in § 6-58.80. Just-cause reasons include, but are not limited to, the following: 

  • Non-payment of rent. 
  • Violation of lease terms. 
  • Nuisance or illegal activity. 
  • Owner move-in or property demolition (with conditions).

     

  1. Relocation Assistance for Displaced Tenants

If tenants are displaced due to circumstances like owner move-ins, demolition, or compliance with governmental orders, they may be entitled to relocation assistance. The specific amounts are determined by unit size, with additional payments provided for vulnerable groups such as seniors or households with children.
 

  1. Protection Against Retaliation

Landlords are prohibited from retaliating against tenants for exercising their rights under the ordinance. Illegal actions include unjust eviction attempts, removal of services, or harassment in response to tenant complaints. If retaliation occurs, tenants may have legal grounds to file for damages. 

If your landlord violates Alameda’s rent control or eviction protection laws—or engages in certain types of harassment or unlawful behavior—you may be entitled to the following legal remedies: 

  • Treble Damages: Under California Civil Code § 1940.2 (for covered tenants), tenants can recover up to three times actual damages if the landlord’s conduct is willful, such as harassment, illegal eviction attempts, or utility shutoffs. Local city ordinances may permit greater or lesser damages, for covered tenants.  
  • Compensatory Damages: This includes financial losses (e.g., rent overcharges, relocation expenses) and emotional distress, especially in cases involving harassment, unsafe living conditions, or sudden displacement. 
  • Attorney’s Fees: Tenants who prevail in court may be awarded their legal fees, making it easier to pursue justice. 
  • Injunctive Relief: Courts can order landlords to stop unlawful actions and comply with local housing protections. 

These remedies are designed to protect renters and hold landlords accountable for violating tenant rights. 

If your unit does not qualify under Alameda’s RCO, you may be covered by the California Tenant Protection Act of 2019, which caps rent increases at 5% plus CPI or 10%, whichever is less, and provides just cause eviction protections for certain properties.
